Under New Brunswick Rules of Court, the other party is entitled to an independent medical examination of injury victims, by a doctor of their choice.
IMEs usually involve a doctor reviewing all the medical records, interviewing the injured victim, conducting a physical examination, tests, and providing a written report.
Typically, the opposing party is only entitled to arrange one independent medical examination, but there are circumstances in which they may be entitled to a second examination.
It should be noted that the purpose of IMEs is not to offer treatment. Rather, their job is to write a report expressing an opinion.
