- Workers’ Compensation/WorkSafe – If you are injured in a work-related automobile or by a motor vehicle, you have the choice to file a through a claim through the Workers’ Compensation system OR the driver/owner (insurer) of the at-fault vehicle. However, it is important to note you cannot do both at the same time.
- Advantages to claiming against the at-fault driver/insurer:
- You can claim pain and suffering and future income (in addition to ongoing loss of income).
- You can access medical/income benefit from the vehicle’s insurance.
- The victim/worker has control over when to settle and for how much.
- It may be worth considering filing a claim through Workers’ Compensation when:

- Facts to know:
- Although only those involved in accidents with motor vehicles may elect to claim against the at-fault driver, the definition of motor vehicle is broad and may include any self-propelled machinery such as excavators, cranes, loaders, and other similar equipment.
- Even if you have already elected to go through Workers’ Compensation, you can re-elect at your choosing. In most cases, it can be advantageous to do so.
