Every case is unique, but we’re equipped to handle it all. Here, you’ll find the most common steps of the personal injury legal process.

Remember: We’ll walk you through the entire process—with care and compassion every step of the way.

When you book a consultation at Correia & Collins, you won’t have to deal with a busy, impersonal intake department. You will meet directly with a personal injury lawyer and discuss the details of your accident and injury, at no cost to you.

You do not need to have anything prepared, but we suggest you have the following:

  • Photos of accident scene and injuries
  • Copy of your pertinent insurance policy
  • Other party’s information, including insurance
  • Other documents related to the accident

Don’t worry if you don’t have all of these things. Talking to us is the most important first step.

Next, we’ll discuss your options. If we believe there’s a case, we’ll begin gathering all the evidence and necessary information, such as:

  • Medical records
  • Police reports
  • Witness statements
  • Expert consultations
  • Documentation of missed work, loss of income, etc.
  • Other evidence of the injury’s effect on your life

After investigation, we’ll start the proceedings—documenting and filing everything as needed, so you spend your time recovering.

Many, but not all, cases are resolved during this step. After building the case, we negotiate directly with insurance companies and the other parties to get you the compensation and care you deserve. We will keep in touch regularly, involving you in the process as needed and giving you updates along the way.

This step is where an experienced and compassionate lawyer is crucial. Discovers often happen during this phase, and insurance companies are notoriously challenging to work with. We have over 30 years of experience to ensure we get you the best settlement possible.

If your case cannot be adequately settled, we may proceed to trial. We’ll prepare your case to present to a judge or jury. Beyond filing papers and appearing in court, we’ll also go through extensive preparation including:

  • Organizing evidence
  • Conducting mock trials, if circumstances of the case warrant it

Next, we’ll start the trial proceedings and fight to get the results you deserve.

Often, this step is not needed—especially when there is a favourable outcome during trial—but there is always a chance of post-trial actions.

If the outcome of your trial is not favourable, we’ll discuss any remaining possibilities including the likelihood of a successful appeal.

If the outcome of your trial is favourable, there may be an appeal from the other party. This is very rare, but we are prepared to continue the work on your behalf to maintain the original decision.
