Until recently, most New Brunswickers only saw electric bikes (e-bikes) when they were visiting a bigger city or on vacation in a foreign country. Nowadays, the use of e-bikes has increased, and for many, e-bikes have become the primary form of transportation in the spring and summer months.
We hope to offer some helpful advice on the law of e-bikes and some safety tips. It is important for e-bike riders and motor vehicle drivers to understand the unique risks posed by e-bikes and how the law applies in these cases.

In New Brunswick’s Motor Vehicle Act, e-bikes fall into the category of “motor driven cycles.”
The key points of the law and regulations for e-bike riders are:
- No Passengers allowed – E-bikes are not allowed to carry or transport another person.
- Stick to the Right – E-bike riders must ride as near to the right side of the road as practical as possible.
- No Side-by-Side – E-bike riders must not ride side-by-side with another e-bike (or motor-driven cycle) except to overtake or pass.
- Always Wear a Helmet – E-bike riders must not drive without a helmet.
In addition to the above rules, e-bike riders must obey all the rules of road—same as everyone else.
For e-bike riders, it’s important to keep your bike in good repair, follow the rules of the road, and ensure the e-bike satisfies the requirements of regulations (linked here).
For everyone else driving on the road, please be mindful that e-bike riders have rights, and because they are only on the road a short period of year, it is important to keep an eye out.
Whether you’re a seasoned e-biker or just a beginner, prioritize caution on the roads. Familiarize yourself with the law and regulations, wear protective gear, and stay alert.
